Varsity Restrictive Covenant

Varsity residents have come together to  implement restrictive covenants to preserve the single-family residential character of the community.  This contract between neighbours limits each property to one single family home for the benefit of the neighbourhood. Residents who participate are helping their neighbours and themselves by protecting the features they enjoy in their community. Community volunteers serve on the Varsity Restrictive Covenant Committee and as Block Captains to assist residents in obtaining RCs.

 In May 2024, City Council decided to implement blanket rezoning, meaning 8 to 12 dwelling units can be built on a 50-foot lot with 60% lot coverage anywhere within the City of Calgary.  Homeowners are understandably concerned that this type of development will negatively affect individual properties and streetscapes in Varsity.

What is a restrictive covenant?

 A Restrictive Covenant is a legally binding private contract between neighbours that is registered against their land titles. Signatories to the RC agree not to subdivide their property or to construct more than one single family home on it. Secondary suites are allowed but backyard suites are prohibited. Those restrictions are binding on current and subsequent owners of that property for the 75-year life of the agreement. The intent of the RC is to preserve the distinct residential character of the neighbourhood and restrict the type of redevelopment and density within it. Participation is voluntary

The courts have been consistent in upholding restrictive covenants and preventing redevelopment that does not comply with the RC. They are a strong deterrent to any development other than single family homes. Numerous communities in Calgary have RCs and many more are implementing them.

The cost to register an RC on your land title is a one-time fee of $750. This includes legal and registration fees and will seed a legal defense fund to defend the RC against attempts to ignore it or remove it.

 Signing the Restrictive Covenant does not create any further financial obligations beyond the initial registration cost. Should it become necessary to take future legal action against a property owner who contravenes the terms of the agreement the participants would collectively determine how to fund the enforcement action. The legal defence fund would assist in this effort.

 The cost is $750.00 for each property.   These fees are non-refundable and will be held in trust with the law firm of Carbert Waite LLP to cover legal expenses for this project.

Select a date and time to meet with the lawyer to sign your restrictive covenant. Fees must be paid 7 days prior to the appointment to give the legal team time to draw up your paperwork.

Attend your scheduled date and time to sign your restrictive covenant with your designated lawyer.  Appointments will occur at the Varsity Community Centre and last approximately 10-15 mins.

Pay your Fees by E-Transfer

Conveniently send your Varsity Restrictive Covenant fees by e-transfer directly to the appointed lawyer. These fees will go towards preparation of legal documents and legal defence fund.

Book your VRC Land title Signing Appointment

Book your restrictive covenant land title signing appointment with a lawyer at the Varsity Community Centre. 


All people on the land title must be present to sign. Only one appointment per household is required.


NOTE: You will be required to submit your e-transfer confirmation/reference number when book your appointment.
